The court heard his case on May 22. Involving disclosure of state secrets, Zhou’s trial was held behind closed doors. Zhou pleaded guilty and will not appeal.

新华网天津6月11日电 2015年6月11日,天津市第一中级人民法院依法对周永康受贿、滥用职权、故意泄露国家秘密案进行了一审宣判,认定周永康犯受贿罪,判处无期徒刑,剥夺政治权利终身,并处没收个人财产;犯滥用职权罪,判处有期徒刑七年;犯故意泄露国家秘密罪,判处有期徒刑四年,三罪并罚,决定执行无期徒刑,剥夺政治权利终身,并处没收个人财产。周永康当庭表示,服从法庭判决,不上诉;进入司法调查以来,办案机关依法办案、文明执法,讲事实、讲道理,充分体现了我国司法的进步,使他认识到自己违法犯罪的事实给党的事业造成的损失,给社会造成了严重影响,再次表示认罪悔罪。

2015年5月22日,天津市第一中级人民法院鉴于周永康案中一些犯罪事实证据涉及国家秘密,依法对周永康案进行不公开开庭审理。法庭通过传唤证人吴兵出庭作证,播放周永康长子周滨、妻子贾晓晔作证录像,宣读、出示相关证人证言、书证、物证照片、鉴定意见等,证实周永康利用职务上的便利,为吴兵、丁雪峰、温青山、周灏、蒋洁敏谋取利益,收受蒋洁敏给予的价值人民币73.11万元的财物,周滨、贾晓晔收受吴兵、丁雪峰、温青山、周灏给予的折合人民币1.29041013亿元的财物并在事后告知周永康,受贿共计折合人民币1.29772113亿元;通过传唤证人蒋洁敏出庭作证,宣读、出示李春城等人证言、司法检验报告等,证实周永康滥用职权,要求蒋洁敏、李春城为周滨、周锋、周元青、何燕、曹永正等人开展经营活动提供帮助,使上述人员非法获利21.36亿余元,造成经济损失14.86亿余元,致使公共财产、国家和人民利益遭受重大损失;通过出示、宣读泄密文件等物证、曹永正证言、搜查笔录等,证实周永康违反保守国家秘密法的规定,在其办公室将5份绝密级文件、1份机密级文件交给不应知悉上述文件内容的曹永正。周永康对所指控的上述犯罪事实证据均当庭表示属实、没有异议。

天津市第一中级人民法院经审理认为,周永康受贿数额特别巨大,但其归案后能如实供述自己的罪行,认罪悔罪,绝大部分贿赂系其亲属收受且其系事后知情,案发后主动要求亲属退赃且受贿款物全部追缴,具有法定、酌定从轻处罚情节;滥用职权,犯罪情节特别严重;故意泄露国家秘密,犯罪情节特别严重,但未造成特别严重的后果。根据周永康犯罪的事实、性质、情节和对于社会的危害程度,法庭依法作出上述判决。

据了解,周永康在庭审最后陈述时说,我接受检方指控,基本事实清楚,我表示认罪悔罪;有关人员对我家人的贿赂,实际上是冲着我的权力来的,我应负主要责任;自己不断为私情而违法违纪,违法犯罪的事实是客观存在的,给党和国家造成了重大损失;对我问题的依纪依法处理,体现了全面从严治党、全面依法治国的决心。

2015年4月3日,天津市人民检察院第一分院将周永康案起诉至天津市第一中级人民法院。据介绍,天津市第一中级人民法院根据最高人民法院下达的指定管辖决定书受理该案后,依法组成合议庭,向周永康送达了起诉书副本,同时告知了其相关诉讼权利和义务。周永康委托的两位律师多次会见了周永康,查阅了全案卷宗。开庭前,法庭召集了由公诉人、被告人、辩护人参加的庭前会议,就管辖、回避、庭审方式、是否申请非法证据排除、是否申请证人出庭等与审判有关的问题听取了控辩双方的意见,组织控辩双方进行了庭前证据展示。庭审中,法庭围绕起诉指控的事实进行了调查,控辩双方进行了举证、质证,并对证人进行了交叉询问。法庭辩论阶段,控辩双方就起诉指控的犯罪事实、法律适用、量刑等问题充分发表了意见。对周永康及其辩护人提出的符合事实、于法有据的辩解和辩护意见,法庭均予以采纳。案件处理过程中,司法机关充分保障了周永康及其辩护人依法享有的各项诉讼权利。

TIANJIN, June 11 (Xinhua) — Zhou Yongkang was sentenced to life imprisonment Thursday for accepting bribes, abusing his power and deliberately disclosing state secrets, the latest and most powerful footnote to the Party’s commitment to the rule of law.

Zhou, 73, was deprived of his political rights for life and had his personal assets confiscated, according to the verdict of Tianjin Municipal No. 1 Intermediate People’s Court.

The court heard his case on May 22. Involving disclosure of state secrets, Zhou’s trial was held behind closed doors. Zhou pleaded guilty and will not appeal.

Zhou was formerly a member of the Standing Committee of the Political Bureau of the Communist Party of China (CPC) Central Committee and secretary of the Commission for Political and Legal Affairs of the CPC Central Committee.

So far the most prominent official taken down by the country’s anti-corruption drive, Zhou’s trial was a symbol of the CPC’s commitment to the rule of law.

The People’s Daily, the CPC newspaper, applauded Zhou’s trial and conviction in its editorial.

“There are no privileged members in front of CPC discipline. There is no privileged citizen in front of the law,” the editorial read. “No matter how much power one holds or how high one’s position, one will surely be severely punished for violating Party discipline and state laws.”

Since taking office in late 2012, the current CPC leadership has taken anticorruption as a “life-or-death matter” for Party and country. The campaign has boosted people’s confidence in, and support for, the Party.

Zhou’s case not only shows the Party’s courage in facing up to weakness and disciplining itself, but is a strong warning to those in power. Only by staying alert to temptation can an official refrain from crossing the line of integrity.

The fundamental purpose of anticorruption is to modernize governance and realize the rule of law. No one will be allowed to go above the law nor to disrupt its implementation.

This is not the end of the battle against corruption. With willingness from both the Party leadership and its ordinary members, with the endorsement of the people and support from the legal system, the country is sure to win the fight.

ACCEPTING BRIBES, ABUSE OF POWER, LEAKING STATE SECRETS

Zhou was convicted of accepting bribes of about 130 million yuan (21.3 million U.S. dollars), according to the judgement.

The court ruled that Zhou had used his position to seek profits for five people, identified as Wu Bing, Ding Xuefeng, Wen Qingshan, Zhou Hao and Jiang Jiemin, and had personally accepted money and property worth 731,100 yuan from the latter.

Money and property worth 129 million yuan was accepted by his wife Jia Xiaoye and son Zhou Bin. Zhou was informed about these bribes after the fact.

According to the judgement, Zhou instructed Jiang Jiemin and Li Chuncheng to assist in the business activities of others, helping them to illegally obtain about 2.14 billion yuan and causing losses to the state of 1.49 billion yuan.

Zhou leaked five “extremely confidential” documents and one “confidential” document to Cao Yongzheng, an unauthorized person, directly contravening the State Secret Law.

The court statement said Zhou had taken “particularly huge bribes,” but had confessed, pleaded guilty and repented his wrongdoing. The majority of the money was accepted by his relatives, without his prior knowledge. Zhou asked his relatives to return their illegal gains. All gifts and cash have now been recovered. These actions constitute “legal and discretionary grounds for lesser punishment.”

The court said that Zhou’s abuse of power and deliberate disclosure of state secrets were “particularly grave,” but his disclosure of state secrets “did not have very serious consequences.”

The court reached its verdict “in accordance with the facts, nature, and details” of Zhou’s crimes, based on the harm done to society.

DEEP REGRET

In his final statement, Zhou accepted the charges. “The basic facts are clear. I plead guilty and repent my wrongdoing,” he said.

“Those involved, who bribed my family, were actually coming after the power I held, and I should take the main responsibility.

“I broke the law and Party rules incessantly, and the objective facts of my crimes have resulted in grave losses of the Party and the nation.

“The handling of my case in accordance with Party rules and the law reflects the authorities’ determination to govern the Party strictly and advance the rule of law,” Zhou added.

FULL PROTECTION OF ZHOU’S LEGAL RIGHTS

On April 3, prosecutors from Tianjin Municipal People’s Procuratorate filed Zhou’s case. The court formed a collegiate bench authorized by the Supreme People’s Court and sent a copy of the indictment to Zhou. It also informed the defendant of his litigation rights and obligations. The two lawyers hired by Zhou held a number of meetings with Zhou and reviewed the case files.

The court also held a pretrial meeting of prosecutors, the defendant and his legal team to hear their opinions and present evidence from both sides.

During the trial, prosecutors and defense attorneys examined the evidence, questioned witnesses and fully expressed their opinions of the facts, application of the law and sentencing. The court supported opinions from the defense that were based on the facts and had legal standing.

Zhou’s wife and son testified through video link while Wu Bing and Jiang Jiemin appeared in court. Other witness statements were presented along with the evidence.

The legitimate litigation rights of Zhou and his defense attorneys were fully guaranteed.

Artist Ai Weiwei opened his solo exhibition of modern art on Saturday at the 798 Art District, which garnered attention from art circles and foreign media in Beijing.

According to the sponsors, the exhibition, titled Ai Weiwei, was approved by local authorities. It disassembled and rebuilt a 400-year-old Ming Dynasty (1368-1644) ancestral hall in two different exhibition spaces. Ordinary visitors will interpret the exhibition as a display of modern civilization versus ancient buildings. Ai will also stage another two exhibitions in Beijing this week.

Ai is the most controversial Chinese mainland artist. He has been given the most favor from both Western political and art circles. In China, audiences know him far more for political reasons than for his art works. Ai in recent years has been awarded various prizes on the international stage, ranging from human rights to art. He can be considered a lucky one among Chinese dissidents.

However, there are controversies within China’s art circles about whether Ai’s art is as valuable as the West claims. Some believe that the West supports Ai out of political interests while Ai has deliberately used his political label to make up for his artistic weakness.

Given the abstract quality of modern art, it’s impossible to assess Ai’s artistic achievements by a uniform standard.

If Ai takes China as the root of his art, he should create more works to enable the Chinese public to understand him and his art. After all, only a few in China are familiar with his work, which must be of regret to an artist.

It’s an important gesture that the local authorities gave permission to Ai’s solo exhibition. The new start is also an opportunity. The environment Ai faces today is different from 2011 when he was involved in a lawsuit.

Art cannot be separated from ideology, however, art, if specifically made to serve ideology, will be ephemeral. This is an experience drawn from history that deserves the attention of all artists. The ideal relationship between artists and politics is supposed to be moderate.

Objectively speaking, Chinese society is still unfamiliar with modern art. It would be meaningful if Ai could produce more works of art that could help broaden the Chinese public’s horizons and boost public interest in modern art.
